Important — Read Before Using This Service

By accessing or using WayToFrench in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including the Release of Liability set out in Section 2 below.

If you do not agree to these terms, do not access or use this service. Your continued use of WayToFrench constitutes acceptance of any updates to these terms. We recommend reviewing this page periodically.

1. Acceptance of Terms

By accessing and using WayToFrench.com (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Release of Liability

2.1 User Responsibility for Account Security

You are solely and entirely responsible for maintaining the confidentiality of your login credentials, including your email address and password. WayToFrench has no access to your password and cannot recover it on your behalf. Any action taken through your account — whether authorised by you or not — is your responsibility. If your credentials are exposed, shared, reused from another service, phished, or compromised through your own device or network, WayToFrench bears no liability for resulting unauthorised access, data exposure, or loss of account access. You agree to use a strong, unique password and to notify us immediately at [email protected] if you suspect unauthorised access to your account.

2.2 Security Measures and Limitations

WayToFrench implements industry-standard security measures including encrypted data transmission (TLS/HTTPS), webhook signature verification, Firebase Authentication, Firestore security rules, and access control mechanisms. However, no system — however well designed — can guarantee absolute security against all possible threats. You acknowledge and accept that despite our reasonable and ongoing security efforts, the Service may be subject to unauthorised access, data breaches, cyberattacks, or other security incidents that are beyond our reasonable control.

2.3 Release for Data Security Incidents

To the fullest extent permitted by applicable law, you release WayToFrench, its owners, employees, contractors, and affiliates from any and all claims, damages, losses, or liability arising from a security incident, data breach, or unauthorised access to your personal data, provided that WayToFrench has implemented and maintained reasonable security practices. In the event of a confirmed breach affecting your personal data, we will notify you in accordance with applicable law and take prompt remediation steps.

2.4 Release for User-Caused Exposure

WayToFrench is not liable for any exposure of your personal information or account data that results from your own actions or omissions, including but not limited to: sharing your password with third parties; using a compromised or shared device; failing to log out on a shared computer; responding to phishing attempts; reusing passwords across services; or storing credentials insecurely. You use the Service at your own risk with full knowledge of these limitations.

2.5 No Guarantee of Uninterrupted Service

WayToFrench does not warrant that the Service will be uninterrupted, error-free, or free from harmful components. Access to the Service may be suspended or terminated for maintenance, security response, or circumstances beyond our control (including but not limited to third-party infrastructure failures, DDoS attacks, or force majeure events). WayToFrench shall not be liable for any losses arising from service interruptions.

2.6 Cap on Liability

To the maximum extent permitted by applicable law, WayToFrench's total liability to you for any claim arising from your use of the Service shall not exceed the greater of: (a) the total amount you paid to WayToFrench in the twelve (12) months preceding the event giving rise to the claim, or (b) CAD $50.00. This cap applies regardless of the form of action, whether in contract, tort, or otherwise, and even if WayToFrench has been advised of the possibility of such damages.

Summary

We work hard to protect your data, but we cannot guarantee perfect security. You are responsible for your own credentials and device security. By using WayToFrench, you accept these limitations and release us from liability for security incidents beyond our reasonable control. If you do not accept this, please do not use the Service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on WayToFrench for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modifying or copying the materials
  • Using the materials for any commercial purpose or for any public display
  • Attempting to decompile, reverse engineer, or disassemble any software
  • Removing any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or "mirroring" the materials on any other server
  • Creating derivative works based on the Service

3. Disclaimer

The materials on WayToFrench are provided on an "as-is" basis. WayToFrench makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

In no event shall WayToFrench or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on WayToFrench, even if WayToFrench or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on WayToFrench could include technical, typographical, or photographic errors. WayToFrench does not warrant that any of the materials on its website are accurate, complete, or current. WayToFrench may make changes to the materials contained on its website at any time without notice.

6. Links

WayToFrench has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by WayToFrench of the site. Use of any such linked website is at the user's own risk.

7. Modifications

WayToFrench may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Canada, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

9. User Accounts

9.1 Account Registration

You are responsible for maintaining the confidentiality of your account login credentials and password. You are fully responsible for all activities that occur under your account. You must notify WayToFrench immediately of any unauthorized use of your account.

9.2 Account Termination

WayToFrench reserves the right to terminate your account and access to the Service if you violate these Terms of Service or engage in any unlawful or unethical conduct.

10. AI-Generated Content Disclosure

10.1 AI Content in Learning Materials

WayToFrench utilizes artificial intelligence technologies in the creation, enhancement, and delivery of educational content, including but not limited to lessons, exercises, explanations, and personalized recommendations. We maintain high quality standards while leveraging AI to improve learning outcomes.

10.2 FTC Compliance & Disclosure

In compliance with the Federal Trade Commission (FTC) guidelines and international consumer protection standards, WayToFrench discloses that certain content on our platform may be AI-generated or AI-enhanced. This includes but is not limited to:

  • Lesson explanations and instructional materials
  • Exercise generation and variations
  • Personalized learning recommendations
  • Automated feedback and corrections
  • Content summaries and quick references

10.3 Accuracy and Limitations

While we implement quality control measures, AI-generated content may contain errors, inaccuracies, or outdated information. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. Users should independently verify critical information and consult authoritative sources when necessary. WayToFrench is not liable for any errors in AI-generated content.

10.4 User-Submitted Content

By submitting content (essays, posts, comments, writing exercises) to WayToFrench, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, and distribute such content for educational and service improvement purposes. You represent and warrant that you own or have the necessary rights to all submitted content. You are solely responsible for content you submit and any consequences thereof.

10.5 User-Generated Content Liability

WayToFrench does not endorse, control, or guarantee the accuracy of user-submitted content. While we may moderate content for policy violations, we are not responsible for any inaccurate, misleading, or unlawful user-generated content. Users who submit content agree to indemnify WayToFrench against any claims, damages, or liabilities arising from their submissions. We reserve the right to remove any user content that violates these Terms or applicable laws.

11. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Post offensive, abusive, or discriminatory content
  • Engage in harassment or bullying
  • Attempt to gain unauthorized access to the Service
  • Engage in any fraudulent or deceptive practices
  • Spam or send unsolicited communications

12. Payments and Subscriptions

12.1 Billing

By purchasing a subscription, you authorize WayToFrench to charge your payment method recurring subscription fees. All charges are in USD unless otherwise specified.

12.2 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. No refunds will be issued for partial billing periods.

12.3 Refund Policy

WayToFrench does not offer refunds for subscription fees. If you believe there was an error with your charge, please contact support within 30 days of the charge.

13. User Data Storage & Activity Logging

13.1 What We Store

By using WayToFrench, you acknowledge and agree that we collect and store the following user-generated data to provide and improve the Service:

  • Writing submissions — essays, open-ended responses, and any text submitted to our AI writing feedback tools
  • Flashcard activity — cards created, reviewed, scores, and spaced-repetition scheduling data
  • Lesson progress — completed lessons, quiz results, scores, and learning path state
  • Mock exam results — scores, answers, timing data, and performance analytics
  • Speaking and listening activity — playback history, pronunciation practice submissions, and listening exercise responses
  • Coaching session data — booking records, session notes (where applicable), and communication logs
  • Platform usage data — pages visited, features used, session duration, login timestamps, and device/browser metadata
  • Community activity — posts, replies, and reactions submitted in community features

13.2 Purpose of Storage

All stored data is used to provide core platform functionality (progress tracking, spaced repetition, AI feedback), improve our AI models and content, ensure account security, and resolve disputes. We do not sell user data to third parties.

13.3 Data Deletion Requests

You may request deletion of your stored data at any time by emailing [email protected]with the subject line "Data Deletion Request" and your registered email address. We will action all deletion requests within 30 days. Note that certain data may be retained as required by applicable law or for legitimate security purposes.

13.4 No Liability for Misuse

WayToFrench is not liable for any misuse of the platform, including but not limited to: submitting false, misleading, or harmful content through writing tools; using AI-generated feedback for purposes other than personal learning; sharing account credentials; or using the Service in violation of these Terms. Any misuse is the sole responsibility of the user. We reserve the right to terminate accounts involved in misuse without notice or refund.

13A. Intellectual Property & Copyright

All content on WayToFrench — including but not limited to course materials, lessons, grammar explanations, vocabulary sets, audio recordings, mock exam content, blog articles, and design elements — is protected by copyright and intellectual property law. Unauthorised use, reproduction, distribution, or modification of any copyright material on this website is strictly prohibited. You may not copy, scrape, republish, or create derivative works from any platform content without express written permission from WayToFrench. Violations may result in account termination and legal action.

14. Limitation of Liability

To the maximum extent permitted by applicable law, WayToFrench shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenue, even if WayToFrench has been advised of the possibility of such damages.

14. Canadian Regulatory Compliance

14.1 PIPEDA Compliance

WayToFrench complies with the Personal Information Protection and Electronic Documents Act (PIPEDA). We collect, use, and disclose personal information only for identified purposes with your consent. You have the right to access, correct, and request deletion of your personal information.

14.2 CASL Compliance (Canada's Anti-Spam Legislation)

All promotional emails and electronic messages from WayToFrench comply with Canada's Anti-Spam Legislation (CASL). We will only send marketing communications to users who have opted in. Each email includes clear unsubscribe instructions.

14.3 AODA Compliance

WayToFrench strives to comply with the Accessibility for Ontarians with Disabilities Act (AODA) standards. We are committed to providing accessible content and will work to resolve accessibility issues reported by users.

14.4 Provincial Privacy Laws

For users in Quebec, we comply with Quebec's Personal Information Protection Law (Bill 64 - PECA). For users in other provinces, we comply with applicable provincial privacy legislation and consumer protection acts.

14.5 Consumer Protection Act

WayToFrench complies with Canadian consumer protection regulations. Users have the right to cancel subscriptions and receive refunds within applicable timeframes as required by provincial law. Payment disputes can be filed through your payment provider.

15. Indian Regulatory Compliance

15.1 DPDP Act Compliance

WayToFrench complies with India's Digital Personal Data Protection Act (DPDP Act, 2023). We process personal data only with explicit consent and maintain transparency about data handling practices. Users have rights to access, correct, delete, and port their personal data.

15.2 IT Act 2000 Compliance

WayToFrench complies with India's Information Technology Act, 2000, including provisions on data protection, cybersecurity, and liability of intermediaries. We maintain reasonable security practices to protect user data from unauthorized access and disclosure.

15.3 RBI Guidelines for Payment Processing

For users in India making payments, WayToFrench complies with Reserve Bank of India (RBI) guidelines for online payment processing. All payment information is processed through certified payment gateways (PayPal, and Stripe for legacy subscriptions) that comply with PCI-DSS standards.

15.4 Consumer Protection Act, 2019

WayToFrench complies with India's Consumer Protection Act, 2019. Users have the right to lodge complaints with consumer protection authorities. We are committed to fair and transparent practices in providing educational services.

15.5 GST Compliance

For subscription services provided to users in India, GST (Goods and Services Tax) applicable rates will be charged in compliance with India's GST regime. All invoices and receipts will clearly indicate applicable taxes.

15.6 Data Localization

Personal data of users in India may be stored on servers located outside India for operational efficiency and backup purposes. However, we ensure compliance with DPDP Act data transfer regulations and maintain adequate safeguards for international data transfers.

16. User Rights Under Applicable Laws

16.1 Canadian Users

  • Right to access and review personal information held by WayToFrench
  • Right to request correction of inaccurate or incomplete information
  • Right to request deletion of personal information (subject to legal obligations)
  • Right to opt-out of marketing communications
  • Right to file a complaint with applicable privacy authorities (federal or provincial)
  • Right to cancel subscription with proper notice as required by applicable law

16.2 Indian Users

  • Right to provide or withdraw consent for data processing
  • Right to access personal data held by WayToFrench
  • Right to request correction, completion, or updation of personal data
  • Right to request erasure of personal data (where permitted)
  • Right to data portability in machine-readable format
  • Right to file a complaint with the Data Protection Board of India
  • Right to lodge consumer complaints with consumer protection authorities
  • Right to request information about third parties with whom data is shared

17. Dispute Resolution & Arbitration

17.1 Binding Arbitration Agreement (ICC)

Subject to exceptions outlined below, you and WayToFrench agree that any dispute, controversy, or claim arising from or relating to these Terms of Service, the Service, your use thereof, or any products or services sold or distributed through the Service shall be settled by binding arbitration administered by the International Chamber of Commerce (ICC) under its Rules of Arbitration.

17.2 Arbitration Procedures

Seat of Arbitration: The arbitration shall take place in Toronto, Canada, or another mutually agreed location.

Language: The arbitration proceedings shall be conducted in English.

Arbitrator: The arbitration shall be conducted by a single arbitrator unless the claim exceeds CAD $1,000,000, in which case three arbitrators shall be appointed.

Costs: Each party shall bear its own attorney's fees and costs, except that WayToFrench shall reimburse reasonable filing, administration, and arbitrator fees if you substantially prevail on your claim.

Relief Available: The arbitrator may award any relief that would be available in court under applicable law.

17.3 Exceptions to Arbitration

The following disputes are excluded from arbitration and may be brought in court:

  • Claims involving intellectual property rights (patents, trademarks, copyrights, trade secrets)
  • Claims for injunctive or equitable relief
  • Small claims that fall within the jurisdiction of small claims courts
  • Claims by Indian users under consumer protection laws (per applicable Indian law)

17.4 Canadian Disputes (Non-Arbitration Path)

If you are a Canadian resident and arbitration is unenforceable or inapplicable, disputes shall be governed by the laws of Canada. Users agree to attempt amicable resolution before initiating formal proceedings. For unresolved disputes, users may appeal to applicable provincial consumer protection authorities or courts of competent jurisdiction.

17.5 Indian Disputes (Non-Arbitration Path)

Notwithstanding the arbitration clause above, disputes involving Indian users shall be governed by the laws of India and may be escalated through:

  • Consumer Redressal Commission (District, State, or National)
  • Telecom Disputes Settlement and Appellate Tribunal (TDSAT)
  • Data Protection Board of India (for data-related issues)
  • Cybercrime authorities (for security breaches)
  • Regular courts of competent jurisdiction as a final remedy

17.6 Grievance Resolution Timeline

WayToFrench commits to acknowledging all complaints within 48 hours and providing resolution or updates within 30 days. For complaints under Indian consumer protection laws, we comply with statutory timeframes for response and redressal. For arbitration proceedings, parties agree to commence proceedings within 6 months of the dispute arising.

19. Minimum Age & COPPA

19.1 Minimum Age

You must be at least 16 years old to create an account or use WayToFrench. Users between 16 and 18 may use the Service but should review these Terms with a parent or guardian. If you are under 16, do not access or use this Service.

19.2 COPPA (United States)

WayToFrench does not knowingly collect personal information from children under 13 in accordance with the Children's Online Privacy Protection Act (COPPA). If we discover that a child under 13 has provided personal information, we will delete it immediately. If you believe your child has created an account, contact us at [email protected] and we will remove the account within 48 hours.

19.3 GDPR — Children (EU/UK)

For users in the European Union and United Kingdom, the minimum age of digital consent is 16 (or 13 in certain EU member states). By creating an account you represent that you meet the applicable minimum age in your jurisdiction. We do not process personal data of children below the applicable minimum age without verifiable parental consent.

20. Exam Results Disclaimer

WayToFrench provides structured study materials, mock exams, vocabulary tools, writing feedback, and coaching services designed to assist you in preparing for French language proficiency examinations including TCF, TEF, DELF, and DALF. However:

  • We make no guarantee of any specific exam score, pass rate, or certification outcome.
  • Exam results depend entirely on individual effort, prior knowledge, test-day conditions, and the examining body's marking criteria — none of which we control.
  • Our content is not produced by, affiliated with, or endorsed by France Éducation International, CIEP, Campus France, or any official exam body.
  • Mock exam scores on our platform are indicative only and may not reflect actual exam performance.

By purchasing a subscription or using our preparation materials, you acknowledge these limitations and agree that WayToFrench is not liable for any exam outcome, including a failed attempt, re-examination fees, or consequential losses arising from an exam result.

21. Coaching Service Disclaimer

21.1 Nature of Coaching

Coaching sessions provided through WayToFrench are educational in nature. Coaches are language instructors, not certified psychologists, therapists, or official exam invigilators. Coaching constitutes personalised guidance and feedback, not a guarantee of exam readiness or certification.

21.2 Session Availability

Coaching sessions are subject to coach availability. WayToFrench does not guarantee specific session times, response windows, or continuity with the same coach. Session bookings are managed via third-party scheduling tools (Calendly). WayToFrench is not responsible for technical issues with third-party scheduling platforms.

21.3 Cancellation Policy

Sessions must be cancelled or rescheduled at least 24 hoursin advance via the booking platform. Late cancellations or no-shows may be counted as a used session at the coach's discretion. WayToFrench is not liable for sessions missed due to user failure to cancel in time.

21.4 No Results Guarantee

Coaching subscriptions are sold on the basis of access to coaching sessions, not on guaranteed exam outcomes. No refund will be issued on the basis of an unsatisfactory exam result following coaching sessions.

22. DMCA & Copyright Takedown

22.1 Safe Harbour

WayToFrench complies with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright legislation. We respond promptly to valid takedown notices and maintain a policy of terminating repeat infringers.

22.2 How to Submit a Takedown Notice

If you believe content on WayToFrench infringes your copyright, send a written notice to our designated agent at [email protected]with subject line "DMCA Takedown Notice" including:

  • Your full name, address, phone number, and email address
  • Identification of the copyrighted work claimed to be infringed
  • The URL or specific location of the allegedly infringing material on our platform
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf
  • Your electronic or physical signature

22.3 Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice to [email protected]. We will restore the content within 10–14 business days unless the original complainant initiates court proceedings.

22.4 Repeat Infringers

Users who repeatedly upload infringing content will have their accounts terminated without refund.

23. GDPR & EU / UK User Rights

23.1 Lawful Basis for Processing

For users in the European Economic Area (EEA) and United Kingdom, WayToFrench processes your personal data under the following lawful bases under GDPR (Regulation (EU) 2016/679) and UK GDPR:

  • Contractual necessity — to provide the Service you signed up for (account management, lesson progress, payment processing)
  • Legitimate interests — security monitoring, fraud prevention, and platform improvement
  • Consent — analytics, marketing cookies, and promotional communications (you may withdraw at any time)
  • Legal obligation — tax records, anti-fraud reporting

23.2 Your GDPR Rights

EU and UK users have the following rights, exercisable by emailing [email protected]:

  • Right of access — request a copy of your personal data
  • Right to rectification — correct inaccurate or incomplete data
  • Right to erasure ("right to be forgotten") — request deletion of your data (subject to legal retention requirements)
  • Right to restriction — restrict processing while a dispute is resolved
  • Right to data portability — receive your data in a machine-readable format
  • Right to object — object to processing based on legitimate interests or for direct marketing
  • Right to withdraw consent — withdraw consent for consent-based processing at any time without affecting prior processing

We will respond to all requests within 30 days. Complex requests may be extended by a further 60 days with notice.

23.3 International Data Transfers

Your data is processed on servers operated by Google (Firebase / Firestore), Vercel, PayPal, and Stripe, which may involve transfers outside the EEA. These transfers are protected by Standard Contractual Clauses (SCCs) and/or adequacy decisions. By using the Service, you consent to these transfers under the safeguards described in our subprocessors list (Section 24).

23.4 Supervisory Authority

EU users have the right to lodge a complaint with their local Data Protection Authority (DPA). UK users may contact the Information Commissioner's Office (ICO) at ico.org.uk. We encourage you to contact us first at [email protected] so we can attempt to resolve your concern directly.
