What Is an LMIA?

An LMIA (Labour Market Impact Assessment) is a document that a Canadian employer must obtain from Employment and Social Development Canada (ESDC) before hiring most foreign workers. It proves that the employer tried to hire a Canadian citizen or permanent resident first and could not find a suitable candidate — so they need to hire someone from abroad.

A positive LMIA means ESDC has approved the employer's need to hire a foreign worker. Combined with a job offer letter, it can be submitted with your Express Entry profile to receive additional CRS points.

How Many CRS Points Does a Job Offer Add?

The 200-point boost (for NOC 00 — senior management) is essentially a guarantee of an ITA since it pushes nearly any CRS score above the cutoff. However, very few people qualify for this. Do You Need an LMIA for the Job Offer Points?

Not always. IRCC exempts certain job offers from the LMIA requirement:

  • You are already working in Canada on a valid work permit and have a full-time, non-seasonal job offer from your current employer
  • International agreements: Jobs covered under CUSMA/USMCA (Canada-US-Mexico), CETA (Canada-EU), or CETA-like agreements
  • Intra-company transfers: You are being transferred within a multinational company
  • Significant benefit to Canada: Certain researchers, cultural workers, athletes
  • Provincial nominees: If you hold a valid provincial nomination certificate, no LMIA needed for job offer points

LMIA Required

  • If you are outside Canada and your Canadian employer offers you a job
  • If the position is not covered by any trade agreement or exemption category
  • Most standard employment offers where no other exemption applies

The LMIA Process: What Employers Go Through

  1. Advertise the position — employer must post the job on Job Bank and other platforms for a minimum period (usually 4 weeks) and document that no suitable Canadian applicants were found
  2. Apply to ESDC — submit the LMIA application with evidence of recruitment efforts, wage details, and job description
  3. Processing — ESDC reviews the application. Processing times vary: 2-5 months for most positions, faster (10 business days) for high-wage positions under the Global Talent Stream
  4. Decision — positive or negative LMIA issued
  5. Job offer letter — once LMIA is positive, the employer issues you a job offer letter with the LMIA number

The LMIA process requires significant effort and cost from the employer (fees, time, paperwork). This is why Canadian employers — especially smaller ones — often hesitate to pursue an LMIA for a candidate they haven't met. Building a relationship with a Canadian employer first (through internships, working holiday visas, or contracts) makes LMIA sponsorship much more likely.

Is the Job Offer Worth Pursuing in 2026?

For most French speakers in 2026, the answer is: not necessarily the first priority. Here's why:

For in-demand tech and STEM occupations, the Global Talent Stream (GTS) offers a 2-week LMIA processing time. If you work in software engineering, data science, AI, or engineering, your employer may be able to sponsor you through GTS much faster than the standard LMIA process. Combined with French language skills, this profile is extremely competitive in 2026.
